Východiskom budú teórie, ktoré reflektujú premenu sociálnej pozície dieťaťa v spoločnosti ako aj zmeny v pozícii dieťaťa ako subjektu práva. Keďže spoločenský účel manželstva má svoje ťažisko v založení rodiny, v riadnej výchove detí a vo vytvorení zdravého rodinného prostredia, pri rozhodovaní o rozvode manželstva, v ktorom sú maloleté deti, súd prihliada na ich práva i záujmy a chráni ich. V rámci výkonu kolízneho opatrovníctva alebo priamo v súdnom konaní na zabezpečenie najlepšieho záujmu a práv dieťaťa sa využíva nástroj, ktorý reprezentuje spôsobilosť dieťaťa zúčastniť sa právnych úkonov a vyjadriť sa k skutočnostiam (tzv. zisťovanie názoru dieťaťa), ktoré sa týkajú jeho výchovy a starostlivosti pre obdobie po rozvode manželstva rodičov. Diskutovať budeme o praxi zisťovania názoru dieťaťa v rámci sociálnoprávnej ochrany dieťaťa ako aj faktoroch, ktoré majú vplyv na posudzovanie jeho významu a dôveryhodnosti v konaniach súvisiacich s rozvodom. In the paper we focus attention on the position of the child as subject and object of the law (legal relations) in the parent's divorce procedure. The theoretical basis lay in theories that reflect the transformation of the child's position in the society as well as changes in the position of the child as a subject and object of the law. Whereas the basic purpose of marriage is set in starting a family for upbringing of child and the creation of a healthy family environment, while deciding on marriage divorce with minors the court shall take into account child's rights and interests and protects them. In accomplishment of custody or directly in court proceedings to ensure the best interests and rights of the child is used a tool that represents the child's ability to participate in the acts and surveying the child's opinion (the detection view of the child) related to the parental upbringing and care for post-divorce time. We will discuss the practice of child's opinion surveying in the social protection of the child system and the factors that affect the assessment of its relevance and credibility in divorce proceedings.
